The overtime rule that was scheduled to take effect on December 1, 2016, raising the salary threshold from $23,660 to $47,476, has been postponed. A federal judge in Texas granted a preliminary injunction on the new overtime rule on November 22, 2016. Until a decision is reached employers may continue to follow the existing overtime regulations.
A lawsuit challenging the rule was filed by 21 states and a variety of employer groups. U.S. District Judge Amos Mazzant said states that challenged the rule were able to effectively show “irreparable harm” if it went into effect, while the Labor Department did not prove it would be harmed if the rule was not implemented.
